These Terms of Service ("Terms") govern your use of the Soft Peony website at softpeony.com (the "Site") and any purchase you make from us. The Site is operated by Soft Peony, 11401 NW 12th St, Miami, FL 33172, United States ("Soft Peony", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. You agree to provide accurate, current and complete information when ordering or creating an account, and you are responsible for keeping your account credentials secure.

2. Products and cosmetic use

  • Our products are cosmetics and personal-care devices intended for external use only. They are not intended to diagnose, treat, cure or prevent any disease, and statements on the Site have not been evaluated by the U.S. Food and Drug Administration.
  • Results vary from person to person. Testimonials and before/after content reflect individual experiences and are not a guarantee of results.
  • Always read the label, ingredient list and instructions before use, and perform a patch test. Stop use if irritation occurs. If you are pregnant, nursing, have a medical condition, an implanted medical device (such as a pacemaker), or sensitive skin, consult a healthcare professional before using our products or devices.
  • We make every effort to display products, colors and packaging accurately, but packaging may change and colors may vary depending on your screen.

3. Prices, promotions and availability

All prices are in U.S. dollars. Prices, promotions and product availability may change at any time without notice. Promotions are valid only for the period and conditions stated. If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel any orders placed for that product and refund you in full.

4. Orders and payment

Your order is an offer to purchase. We may accept or decline any order, limit quantities, or cancel an order if we suspect fraud, resale, or an error. Payment is processed securely by our payment providers; we do not store your full card details. You authorize us to charge your selected payment method for the total amount of your order, including taxes and shipping.

5. Shipping, returns and refunds

Shipping is described in our Shipping Policy, and refunds and warranty in our Refund & Return Policy. Both are part of these Terms.

6. Reviews and content you submit

If you submit reviews, photos, videos or other content, you confirm it is truthful, reflects your own experience, and that you have the right to share it. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display that content in connection with our business, including on the Site and social media. We may remove content at our discretion. We will not use your name or likeness in paid advertising without your permission.

7. Acceptable use

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping data, uploading harmful code, placing fraudulent orders, or using the Site for any unlawful purpose.

8. Intellectual property

All content on the Site — including text, images, videos, graphics, logos and design — is owned by or licensed to Soft Peony and protected by intellectual property laws. You may not copy, reproduce or use it without our written permission. Third-party brand names and trademarks belong to their respective owners.

9. Third-party services and links

The Site may contain links to or integrations with third-party websites and services (such as payment processors, carriers and review platforms). We are not responsible for their content, policies or practices.

10. Disclaimer of warranties

Except as expressly stated in our Refund & Return Policy (including the device warranty), the Site and products are provided "as is" and "as available", to the fullest extent permitted by law, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free. Nothing in these Terms limits your rights under the Federal Trade Commission's rules or other consumer protection laws that cannot be waived.

11. Limitation of liability

To the fullest extent permitted by law, Soft Peony and its owners, employees and partners will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim related to a purchase will not exceed the amount you paid for that purchase. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Soft Peony from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site or products.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in the State of Florida. Before filing any claim, you agree to contact us first at support@softpeony.com so we can try to resolve the issue informally.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Changes don't apply to orders placed before the update.
